This is a working draft. It has not been reviewed by a lawyer, and it will change before ShiftPort is offered publicly.
ShiftPort is a tool for capturing what happened on a construction site each day and turning it into the paperwork a contractor already has to produce. These terms are the agreement between us and the company using it.
Everything you capture — your crews, your hours, your reports, your photographs — belongs to your company. We hold it so the app can work. We do not sell it, we do not use it to train anything, and we do not show it to another contractor.
You can take it out at any time, in a format that can be read without ShiftPort. If you close your account we will delete it on request.
Signing in is an emailed six-digit code, so keep your email secure. The first person in a company is its owner; they decide who else gets in. Tell us if you think somebody has reached your account who should not have.
Most people named in ShiftPort — the crew — never sign in. If you put their names, hours and signatures in, you are responsible for having told them that you keep this record and for it being accurate.
ShiftPort records what you tell it. It does not check that a safety talk was given, that hours are correct, or that a report satisfies a regulator, an owner or a collective agreement. Those remain yours.
It is not a payroll system and not a substitute for advice from anybody qualified to give it.
We work at keeping it available, and it is built to keep capturing with no signal so a bad connection does not stop the day. We cannot promise it is never down. If we are going to change something that would get in your way, we will say so first where we can.
ShiftPort is free to use while it is being tested with its first contractors. If that changes you will be told before anything is charged, and you will be able to take your data and leave.
Nobody can promise software is faultless, and a construction record is something you may have to stand behind, so keep whatever independent records your obligations already require. Our liability to you is limited to what you have paid us, which for now is nothing.
That is the standard clause, and it is also the honest description of a tool being tested. It is the sentence to ask a lawyer about first.
You can stop using ShiftPort whenever you like and take your data with you. We can close an account that is being used to reach data it should not, or in a way that puts somebody at risk — and we will say why.
ShiftPort is run from Ontario, Canada, and these terms are read under Ontario law.
